 Do you need prescription to buy a CPAP mask?
Do you need prescription to buy a CPAP mask? If so why can you buy CPAP stuff on ebay? If so why when I order from companies on the internet they don’t ask for the prescription when I buy a new mask?

You do not need a prescription to by a cpap mask. Many local DMEs will say you do, but they do so because it makes getting reimbursed by the insurance company easier.

I thought I read somewhere recently that ebay were refusing to accept used cpap equipment for online auction ?
I'm not well up on ebay, I might be wrong.

 Legal aspects of a prescription for a mask
The packaging for a mask may give you the best bet on your question. Most packages state: "In the USA, federal law restricts this device to sale by, or on the order of, a physician."
Therefore an order or current presciption is needed. In some heathcare communities a current presciption is one issued within the past year.

I checked FDA law you can sell the Mask and cpap accessories without prescription. You cannot sell the machine. Now the company will restrict the sell of their product by saying trademark or copyright protect product which only pre authorized companies may sell.
Whatever the corporate greed sickens me I will speak of it no more.

eBay by policy does not permit CPAP/BiPAP equipment and accessories ro be posted; I recently tried posting a BiPAP only to have it removed by eBay the next day. When I complained to eBay, because there are many other CPAP/BiPAP listings out there, I got this for a response ...
"If a listing is ended or removed, it is because the item was prohibited,
questionable, infringing or potentially illegal as stated in the User
Agreement and a specific complaint was reported. Since cpap/bipap
machines require a prescription to obtain and their accessories are
highly regulated, eBay has made the decision to prohibit these items
across the boards. Listed items similar to the one you had removed will
remain on the site unless eBay is notified about them."
My feeling is that another eBayer reported my listing as a way of reducing competition. So, I'm still searching for a way to sell by Respironics BiPAP Pro with Bi-Flex.

To muddy the waters even further.
You can sell your CPAP machine according to the FDA. However, it has to be as it was originally sold. In other words, original packaging, instructions etc. Additionally, the person buying it has to have a prescription. Ebay's stance is more than likely due to the fact that they can't be sure that either of those conditions are met. (and a bit of prodding by a certain manufacturer didn't hurt either  )

 Accessories on line
Got my CPAP yesterday. Having a tendency to break things, I wanted an extra mask.
The original mask cost me $121.00. Just bought a second mask on line for $64.10 including shipping. Granted, insurance pays a portion of the $121.00 and doesn't pay any of the $64.10, but this is quite the mark up.
