I found the answer to my own question;
eBay previously prohibited the sale of CPAP machines and all related
items, but now allows the items as long as they are correctly listed in
the medical equipment category and only that category. I understand the
confusion regarding this issue as a CPAP category is currently
available, but eBay requires all medical equipment to be listed in the
Business, Office & Industrial category only.
The > Business, Office & Industrial > Healthcare category is a category
that is intended for use by licensed buyers and sellers of professional
medical equipment and supplies. You must follow special rules when
listing in this category.
If you list in this category, you are responsible for complying with all
laws applicable to the sales of professional medical equipment. By
listing in this category, you certify that you will comply with all such
laws (including, if applicable, the completion and filing of an FDA
form), and you certify that you will confirm that the high bidder is an
authorized purchaser. Consult the FDA's Website:
http://www.fda.gov/cdrh/consumer/index.html
for more information.
In addition, you must include the following in your item description:
1. Your complete business name, city and state, and type of business
(i.e., hospital, medical office, manufacturer, distributor, broker,
etc.); and
2. The following language: "The sale if this item may be subject to
strict regulation by the U.S. Food and Drug Administration and state and
local regulatory agencies. If so, do not bid on this item unless you
are an authorized purchaser. If the item is subject to FDA regulation,
I will verify your status as an authorized purchaser of this item before
shipping of the item."For the health and safety of eBay users, eBay
requires sellers of used medical devices (for example, thermometers and
breast pumps) to comply with each of the following when listing such
items on eBay:
